When we need to obtain information from you, we will always ask you to provide it voluntarily and expressly. The data collected through the data collection forms on the website or other means will be incorporated into the Valderrama Foundation’s processing systems.

2. For what purpose do we process your personal data and what categories of data do we collect?

At Valderrama Foundation, we process the information provided by interested parties in a fair, lawful and transparent manner. Depending on the form you have used, we will process your data for the following purposes:

A. If you are a Donor (Donation Form):

We will process your data to manage the collection of the donation, issue the corresponding tax certificate, and comply with anti-money laundering regulations. We will also use your data to keep you informed of our activities, projects, and events.

  • Data collected:
    • Identifying details: Name, Surname(s), NIF/CIF.
    • Contact: Postal address, e-mail address.
    • Financial/Banking: Donation amount, IBAN/Account number, frequency.

B. If you are applying for one of our scholarships (Volunteer Form):

We will process your data to manage and evaluate your application to our Scholarship programme, contact you and keep you informed of our activities, projects and events.

  • Data collected:
    • Identifying information: Name, Surname, Date of birth, profession of legal guardians.
    • Contact: Telephone number, postal address, email address.
    • Others: Date of registration with the Golf Federation, handicap, information, documentation, and academic details.

C. If you contact us (Contact Form):

We will process your data to manage, study and resolve queries made through the website.

D. If you subscribe to the Newsletter:

We will process your data to send you informative communications about our activities, projects, and events.

3. What is the legal basis for processing your data?

The legal basis for processing your data depends on the relationship you have with us:

  1. Consent (Art. 6.1.a GDPR): For the Contact, Volunteering and Newsletter forms, the legal basis is the consent you give us by ticking the box accepting the privacy policy before submitting the form.
  2. Legal Obligation (Art. 6.1.c GDPR): For Donors, the processing of their tax and financial data is necessary to comply with legal obligations (Law 49/2002 on the tax regime for non-profit organisations and tax regulations).

4. How long will we keep your data?

  • Enquiries and newsletters: Until the enquiry is resolved or until the user revokes their consent (by unsubscribing from the newsletter).
  • Volunteers: For the duration of the volunteer relationship and subsequently for the legal periods necessary to address any potential liabilities.
  • Donors: Data relating to donations will be kept for a minimum period of 10 years in order to comply with anti-money laundering regulations and tax obligations.

In general, data will be kept duly blocked when it is no longer necessary for the initial purpose, remaining available exclusively to judges and courts or competent public administrations.

5. To whom will your data be disclosed?

Valderrama Foundation will not disclose data to third parties unless legally required to do so. However, the following necessary communications are envisaged:

  • State Tax Administration Agency (AEAT): For the declaration of donations (Form 182) in the case of donors.
  • Financial Institutions: For managing collections and payments.
  • Service providers: Valderrama Foundation has service providers (web hosting, email marketing platforms, administrative services) who may have access to data in order to provide their services. This relationship is regulated in accordance with Article 28 of the GDPR, ensuring that they will only use the data for the contracted purpose and with appropriate security measures in place.

6. What are your rights when you provide us with your data?

Any interested party has the right to obtain confirmation as to whether Valderrama Foundation is processing personal data concerning them. You may exercise the following rights free of charge:

  • Access: Check what personal data we hold about you.
  • Rectification: Modify inaccurate or incomplete data.
  • Deletion: Request that we delete your data when it is no longer necessary.
  • Objection: Object to the processing of your data in certain circumstances.
